Privacy and Data Protection Policy
In accordance with the current legislation on data protection, the company LLC “INFORMATION AGENCY “FREE UKRAINE” (hereinafter – River Mall) informs users (hereinafter – the User) of its Internet platform (hereinafter – the Platform) about the Privacy and Data Protection Policy (hereinafter – the Policy), which is applied by River Mall when processing personal data voluntarily provided by Users who registered on the website https://rivermall.ua/ (hereinafter – the Site) or in the mobile application (hereinafter – the Application).
By providing River Mall with their personal data via electronic forms posted on the Site or in the Application, Users expressly consent to River Mall or any of River Mall’s subsidiaries processing such data in accordance with the terms of the Policy and for the purposes set forth in this Policy.
Users must read this Policy before registering on the River Mall Platform.
By clicking the “register” button, Users hereby declare that they have read the Data Policy and expressly agree to it.
During registration, Users may provide the following information to create or edit their account: username, email address, phone number and credit card details. In addition, and subject to the Users’ consent, River Mall collects data related to the Users’ location, including the real-time geographic location of their computer or mobile device.
Immediately after completing the registration process, all Users will have access to their profile, which they can complete and/or edit as they see fit. Users can access and edit their account. The information and data provided by Users will be included in their account and can be changed using the “edit profile” function.
Users are obliged to provide true and accurate data. In addition, Users are responsible for any loss or damage that may be caused to River Mall or any of its subsidiaries or third parties as a result of the information provided being false, inaccurate, outdated or invalid.
The data collected by River Mall or any of its subsidiaries is used only to achieve the purposes set out in the General Terms and Conditions of Use of the Site and/or the Application.
Legislation applicable to Users’ personal data (Personal data protection)
River Mall undertakes to comply at all times with the applicable legislation on the protection of personal data. Users are informed that the personal data they provide on the Site and/or in the Application are subject to automatic processing and become part of files belonging to River Mall, which will act as the personal data controller for the purposes of managing Users who have registered on the River Mall online platform.

In accordance with applicable law, we have created a Privacy Policy that River Mall uses when processing the data of Users registered on the Platform.

What information does River Mall collect?
The information we receive from Users is collected in accordance with the provisions set out below.
River Mall collects information directly from Users, as well as information provided indirectly through the use of the River Mall Platform.
Registration Data:
information provided by Users when creating an account on the River Mall Platform: Username and email address.
User Profile Information:
information added by Users on the Platform in order to be able to use the River Mall services, i.e. mobile phone number and email address. Users can view and edit their personal data whenever they wish. River Mall does not store the Users’ credit card details, only the card mask, but such details are transferred to licensed electronic payment operators who receive the data and store them in order to facilitate the payment process for Users and manage such data on behalf of River Mall. River Mall does not store such data on its servers under any circumstances. Users may delete their bank card details linked to their account at any time. This will force the service provider to delete such information. In such a case, in order to place new orders on the Platform, these details will need to be entered again. Users may request such providers to provide them with their privacy policy at any time.
Additional information that Users wish to provide:
any information that the User may provide to River Mall for other purposes. Examples include a photograph of the User.
River Mall Contact Information:
River Mall has access to the information provided by Users to resolve any questions or complaints regarding the use of the Platform, via the Feedback Form, by email or by phone through customer support.
River Mall collects data that is created each time Users interact with the Platform.
Application and Device Data:
River Mall stores data on the device and in the Application that Users use to access the services. Such data is:
– The IP address that each User uses to connect to the Internet via their computer or mobile phone.
– Information about the User’s computer or mobile phone, such as the Internet connection method, browser type, operating system version, device type.
– Full URLs of the visit history, including date and time.
User Account Data:
– Information about parking payments made by each User.
– Browser site visit history and preferences.
– Data on where the user accesses the Platform from: if the User accesses the RiverMall Platform from an external source (such as a link from another website or a social network), River Mall collects data about such source.
– Data obtained as a result of incident management: if the User contacts the River Mall Platform using the Feedback Form or by calling River Mall, River Mall collects the messages received in the format used by the User and may collect and store them in order to manage existing or future incidents.
– Data obtained from cookies: River Mall uses its own and third-party cookies to facilitate Users’ browsing of the Site pages, as well as for statistical purposes.
– Data obtained from third parties: River Mall may collect personal data or information from third parties only in cases where the User has given permission to such third parties to disclose such information to River Mall. For example, if a User creates an account through their Facebook account, Facebook may disclose to us such User’s data that may be contained in their Facebook profile (such as name, gender or age).
The User may control the information provided by a third party in accordance with the privacy policy of such third party.
– Geolocation Data: Subject to the Users’ consent, River Mall will collect data regarding their location, including the real-time geographic location of their computer or mobile device.
For what purpose is the data collected?
1. In order to use the River Mall Platform
1.1. River Mall uses the data received from Users to provide them with access to and the ability to interact with the River Mall Platform, as well as to provide the services requested by Users through their account on the River Mall Platform in accordance with the procedure described in the Terms of Use. When using the platform, the data may be used:
By the Customer Service Department with which River Mall has entered into an agreement, in order to alert the User to any possible incidents or to ask the User why he/she left a negative review about the service provided. River Mall may use the data provided in the order to manage any incidents that may arise during the provision of the services.
They may also be used to show Users all parking payments made through the Platform and to provide them with the opportunity to express their opinion on the services provided by River Mall.
By the Payment Platform for billing Users.
1.2. River Mall may use the personal data provided by Users to communicate with Users via e-mail or via SMS messages regarding the activities of the service. When registering a User on the Platform, he/she is deemed to agree to the Policy and authorize River Mall to send such messages.
1.3. River Mall also uses information to conduct research and analysis in order to improve the services provided to Users, as well as to develop and improve the characteristics of the services provided by River Mall. River Mall uses information for internal statistical purposes in order to analyze the behavior of Users, understand how Users use the River Mall Platform, and improve the services offered, including the possibility of adding new, diverse services to the Platform.
The processing of the data described above is necessary for the performance of the contract between Users and River Mall, which is concluded by accepting the Policy when registering on the River Mall Platform. The execution of the aforementioned contract is the basis that legitimizes the processing of data carried out by River Mall or third parties for the purpose of providing services requested by Users through the Platform.
2. To ensure security and a proper environment for reliable service provision.
2.1. River Mall may use data to ensure proper use of the products offered by the Platform (for example, providing feedback to the User).
2.2. River Mall may also use Users’ information to identify and investigate fraud and other illegal activities, as well as violations of the Privacy Policy. For this purpose, RiverMall may disclose Users’ data to platforms engaged in the analysis of fraudulent activities.
River Mall may use the information provided by Users to process data as described above, in accordance with the legitimate interests in the protection and proper use of the Platform and applicable law, as well as to ensure proper and safe provision of services.
3. Advertising and commercial offers (online and offline)
River Mall uses third-party technologies integrated into the Platform to collect Users’ data and their preferences and uses them together with customer relationship management systems and advanced technologies for the benefit of Users. Therefore, data processing is based on the information collected:
3.1. River Mall may send Users to their email addresses advertising messages and/or offers related to services offered by River Mall that may be of interest to Users. River Mall may evaluate and personalize such advertising messages according to Users’ preferences. If the River Mall User does not wish to receive information and/or advertisements, he/she may unsubscribe at any time (such possibility is provided in the email). In such case, River Mall will immediately stop sending the aforementioned information.
3.2. River Mall may send Users messages and/or offers related to services to mobile phones via push notifications containing advertising information and/or offers. If the River Mall User does not wish to receive advertising messages described in this section 3, he/she may disable such function with one click in the privacy settings of his/her profile.
3.3. By using the River Mall Platform, Users consent to receive commercial messages from third parties associated with the Platform, such as Facebook and Google, Viver, Telegram, WhatsApp. push notifications, as well as commercial messages to their own email, in accordance with the privacy settings set by each User on the Platform.
The data processing described above is carried out in accordance with the legitimate interests of River Mall in carrying out marketing activities for the benefit of Users, as described in the following section. It should be noted that Users can use their privacy management center to opt out of online marketing services or to close their account if they do not wish to receive samples with River Mall orders.
Does River Mall disclose the information it collects?
As stated in the previous section, the personal data collected by River Mall will only be used to achieve the purpose set out in the Terms of Use.
In order to fulfill contractual obligations, to provide flawless services, and for its own legitimate interests, River Mall discloses certain personal data of Users:
– To the social networks used by the User to use the application. If the User links their River Mall account to another social network or third-party platform, River Mall may use the information provided to such social network or third party, provided that such information is provided to River Mall in accordance with the privacy policy of the social network or third-party platform.
– Users may receive emails from River Mall to solicit User feedback on the stores. Under no circumstances do the stores receive or have the right to request Users’ credit card details. This Privacy Policy does not apply to information provided by Users to the stores that is outside the control of River Mall.
– River Mall ensures that all commercial partners, technical specialists, suppliers or independent third parties are contractually obligated to process the information provided to them in accordance with River Mall’s instructions, this Privacy Policy and applicable data protection laws.
– To security and law enforcement agencies: River Mall may disclose personal data of Users’ accounts if it believes that such disclosure is necessary to comply with the law, to enforce or apply the Privacy Policy or to protect the rights, property and safety of River Mall, its Users or third parties. The above includes sharing information with other companies and organizations, as well as with law enforcement agencies to protect against fraud and reduce credit risks.
– To Payment Operators: River Mall does not store Users’ credit card details. However, Users’ credit/debit card details (number and expiration date) are stored by payment operators selected by River Mall, which have high-level security measures as they comply with the payment card industry data security standard. If the User requests to delete information related to a payment method entered by him/her in his/her profile, the third-party payment operator deletes such information from its servers.
– Limited Liability Company “Misto Park Service” (EDRPOU code 43133921, address: 02081, Kyiv, Dniprovska Naberezhna, 12) (hereinafter referred to as “Misto Park Service” LLC), which is a partner of River Mall, which provides parking services and accepts payment for parking from Users. “Misto Park Service” LLC receives information about the User only to the extent necessary for the proper provision of parking services, namely: license plate number and make of the car, its photo. “Misto Park Service” LLC is obliged by contract to process the information provided to them in accordance with the instructions of River Mall, this Privacy Policy and applicable data protection legislation.
– River Mall may disclose information to executive authorities and/or third parties if required by law in connection with the investigation of criminal cases and illegal activities.
– River Mall Users’ data is stored on DeNovo servers located in Ukraine and with which RiverMall has concluded agreements. River Mall declares that the aforementioned servers comply with applicable data protection legislation and the obligations set out in this Privacy Policy. – River Mall Users’ data is not disclosed to any third party, except in the following cases: (i) it is necessary to provide the requested services, if River Mall cooperates with third parties; (ii) River Mall has the User’s express and unambiguous consent; (iii) a competent authority requires disclosure of information in accordance with its duties (for conducting an investigation, to prevent illegal actions); or (iv) in accordance with the law.
– With the User’s consent: in addition to the above, Users are informed if any of their data is to be disclosed to commercial partners of the Platform and/or the website for purposes other than those set out in the River Mall Privacy Policy, in order to give Users the opportunity to decide whether to grant permission for the disclosure of information or not.
– Also with the User’s consent: to third parties that are not commercial partners and are not affiliated with RiverMall, provided that the User has provided prior, unambiguous consent to the disclosure of their personal data.
In no case may the disclosure of data be carried out for the purpose of exchanging, selling or renting the Users’ personal data for commercial purposes or contrary to the obligations set out in this Privacy Policy.
What rights do Users have?
– How long do we store your personal data?
Except for cases where the data subject requests the deletion of their personal data, such data is stored for 4 years from the moment of the last interaction with the Platform.
If the User withdraws their consent to the processing, the data is blocked and their processing is terminated. The data is stored for 4 years in order for River Mall to be able to make a claim or defend itself against any claims.
– Right to withdraw consent
Users may withdraw their consent to the processing of their data by River Mall at any time.
To do this, they need to fill out and submit the Feedback Form, which is located at: https://rivermall.ua/. Data Subjects
– What information can the User access?
River Mall guarantees Users access to information related to their account in the mobile application. Users can view such information and, in some cases, update it.
All Users can access their profile, the ability to complete and/or edit it if they deem it necessary. As indicated above, Users can access and create an account through their Facebook profile. The information and data provided by Users are always available in the User’s account and can be modified by them using the “edit profile” function.
– Right to access, rectification, erasure, restriction of processing or objection to processing, as well as the right to data portability
The right of access is a right that Users may request from River Mall if River Mall processes any of their data together with the information.
Users may request River Mall to correct any incomplete data contained in the RiverMall database.
The right to erasure allows Users to request River Mall to erase their personal data.
If the User requests this accordingly, River Mall will restrict the use of their data within the limits provided for in the aforementioned section.
Users also have the right to object to the processing of personal data that River Mall stores.
Since the exercise of these rights is a personal matter, data subjects must prove their identity. To do this, it is necessary to provide River Mall with a written request (which will contain the data subject’s signature, address and a copy of a passport or other identification document) using the River Mall Feedback Form or by e-mail to info@rivermall.ua.
– What are the options available to Users?
As stated above, if the User no longer wishes to receive e-mails from River Mall, they can change their subscription settings by clicking on the appropriate button in the mobile application.
In addition, Users may not provide River Mall with geolocation data. Most mobile devices provide Users with the option to disable location services. This option can usually be found in the device settings menu. If you have any doubts about disabling location services on your device, River Mall recommends that you contact your device manufacturer or service provider.
In addition to the rights described above, Users have the right to file a complaint with a supervisory authority.
How do we protect Users’ data?
In accordance with the nature of the personal data processed and the circumstances of the processing, River Mall takes the necessary steps recommended by the competent authority to maintain an appropriate level of security, in order to avoid (as far as possible and always in accordance with the state of technology) alteration, loss, unauthorized access to or processing of the data. As stated above, the personal data provided will not be disclosed to third parties without the prior consent of the data subject.
Notification and Modification
As stated above, all Users have the right to access, update and delete their data, as well as to object to the processing of their data. You can exercise your rights and make any requests regarding the River Mall Privacy Policy using the Feedback Form or by email info@rivermall.ua.
Deleting User Personal Data.
1. The User can delete their personal data from our mobile application by going to the “Profile” section and following these steps:
1.1 Click on the “Edit” icon in their profile.
1.2 Select the “Delete Account” option.
1.3 Confirm your intention to delete the account by answering the appropriate confirmation question in the pop-up window.
2. After completing these steps, all personal data of the User, such as name, phone number, email, age and gender, will be permanently deleted.
3. If the User needs to use the application again, they will have the opportunity to re-register their account in the application.
Due to the fact that River Mall is constantly developing, this Privacy Policy and Terms of Use may change. River Mall will notify Users of any material changes or modifications to these documents by email or other means that ensures their receipt by Users. River Mall will not change its policy in any way that may result in a reduction in the effectiveness of our Users’ personal data protection.
R E G U I L I N G
ON PARKING ACTIVITIES
1. General Provisions
1.1. These Regulations on Parking Activities (hereinafter referred to as the “Regulations”) define a single procedure for organizing and operating the Parking in order to ensure proper conditions for Car Owners when using Parking services.
The Regulations regulate the relationship between the Parking Administration (Limited Liability Company “Misto Park Service”, EDRPOU code 43133921) and the owners of Vehicles (hereinafter referred to as the “Vehicle Owner”) who use the services of multi-level parking, namely: underground, indoor, open parking, which are located in the RIVER MALL shopping and entertainment center at the address: Kyiv, Dniprovska embankment, building No. 12 (hereinafter referred to as the “Parking”).
These Regulations are a public agreement within the meaning of Art. Art. 633, 641 of the Civil Code of Ukraine, their terms are the same for all Car Owners, regardless of their status (individual, legal entity, individual entrepreneur. The subject of this public agreement is the provision by the Parking Administration of Services for placing Vehicles in the Parking and the fulfillment of the terms of these Rules by the Car Owners. The public agreement comes into force from the moment of Acceptance of the offer and is valid until its full fulfillment.
In accordance with Part 2 of Article 642 of the Civil Code of Ukraine, the entry of the Car Owner by Vehicle into the Parking area is an acceptance of the offer to conclude an agreement for the provision of services for placing Vehicles in the Parking area (acceptance of the offer) and certifies the Car Owner’s desire to conclude this agreement and confirms the Car Owner’s consent to comply with the Parking Use Rules set out below.
From the moment of entry by the Vehicle into the Parking area, the Car Owner fully accepts the terms specified in the Regulations, including tariffs for the use of Parking Spaces, sizes losses that the Car Owner is obliged to compensate in favor of LLC “Misto Park Service” in the event of damage caused by the Car Owner in the amount set out in Appendix No. 1 to the Regulations, and all other terms of the Rules.
1.2. The main terms used in these Regulations:
1.2.1. Placement of Vehicles – temporary location of a Vehicle in the Parking area.
1.2.2. Parking space – a place in the Parking area for placing one Vehicle, limited by marking contours with a corresponding serial number.
1.2.3. Payment for the use of a parking space – a mandatory payment made by Car Owners for using Parking services, according to the tariffs determined by the Parking Administration.
1.2.4. Vehicles – passenger cars, minibuses, motorcycles, scooters, trailers and others.
1.2.5. Car Owners – owners and users of Vehicles, whose right to ownership or use is confirmed by relevant documents.
1.2.6. Persons with disabilities are persons with disabilities who have an appropriate document certifying the right to free parking of a Vehicle, who have an appropriate certificate of a recipient of state social assistance paid instead of a pension, or a certificate of a person receiving state social assistance in accordance with the Law of Ukraine “On State Social Assistance to Persons with Disabilities from Childhood and Children with Disabilities”, or a certificate for receiving benefits by persons with disabilities who are not entitled to a pension or social assistance, which contains a record of disability.
1.2.7. Parking Administration – a legal entity authorized by the Parking Owner that carries out commercial operation of the Parking on the basis of a concluded lease agreement.
1.2.8. Parking Employees – employees authorized by the Parking Administration who perform work on the provision of services for the placement of Vehicles, maintenance of the Parking and provide other services.
1.2.9. Parking Pass – a fixed-term document (plastic card) certifying the conclusion of an agreement between the Parking Administration and the Car Owner for the use of the Parking, the fact of payment by the Car Owner to the Parking Administration for the use of a parking space, and is confirmation of the right to stay the Vehicle in the Parking, access to the Parking.
1.2.10. Parking Ticket – a document certifying the conclusion of an agreement between the Parking Administration and the Car Owner for the use of the Parking, is a one-time pass for entry and exit from the Parking and records the date and time of the start of using the Parking. Receiving a Parking Ticket certifies the Car Owner’s agreement with these Regulations.
1.2.11. Parking Usage Period – the period for using the Parking, which is calculated from the moment of receiving the Parking Ticket upon entering the Parking, until the moment of payment for using the Parking at the parking meter or mobile application before leaving the Vehicle from Parking. The term of use of the Parking based on the Parking Pass is calculated from the moment of payment for the Pass and is valid for one month.
1.2.12. Loading and unloading area of the Parking Lot (Ramp) – a zone specially designated by the Parking Lot Administration or the Shopping Center Administration, which is marked with markings on the Parking Lot territory and is used for loading and unloading cargo delivered to the Shopping Center Administration or the Shopping Center tenants.
2. Tariffs for using Parking services
2.1. The Car Owner uses the Parking under the following tariffs and conditions:
1. Parking ticket – “Standard”: Upon entering the Parking area, 30 minutes are provided to the Car Owner
free of charge. Motorcycles, mopeds, motorized strollers – 5 hours free of charge Each subsequent hour – 50 UAH.
2. Parking ticket – “Daily”: The Car Owner’s Vehicle is located in the Parking from 10 hours to 24 hours – 700 UAH.
3. Parking subscription “Without restrictions” The Car Owner uses Parking services for one month
7,000.00 UAH. per month.
3. Organization of Parking Operation
3.1. These Regulations, Parking Operation Schedule, information on Parking Service Tariffs, Fire Safety and Safety Rules, Parking Plan with the Direction of Vehicles, Emergency Evacuation Plan for Vehicles, Telephone Numbers of the Parking Administration, State Consumer Protection Authorities, Police, Fire Department, Ambulance, Book of Complaints and Suggestions, Sample Forms for Registration of Documents for Parking Use shall be posted in a prominent place on the Parking Area.
3.2. The Parking Administration shall provide the Car Owner with convenient conditions for placing the Vehicle.
3.3. For the convenience of Car Owners, an automated system for recording and controlling the entry and exit of Vehicles has been introduced in the Parking Area.
3.4. Placing Vehicles in the Parking Area is carried out around the clock.
3.5. The Parking accepts Vehicles that are registered in accordance with the current legislation of Ukraine (or any other country that does not contradict the legislation of Ukraine) and have a state license plate.
It is strictly forbidden to accept a Vehicle into the Parking for any period without a state license plate!!!
3.6. The Parking Administration is not responsible for the safety of the Vehicle, its completeness and the safety of the property located in it.
3.7. Entry to the Parking area is carried out only through the barrier, near which there is a counter where the Car Owner receives a Parking Ticket or applies a Parking Pass for reading. Exit from the Parking is carried out through the barrier.
4. Use of Parking Services
4.1. Use of Parking Services upon receipt of a Parking Pass
4.1.1. When registering as a Parking Subscriber, the Car Owner must present to the responsible Parking employee:
– technical passport (technical ticket) of the Vehicle;
– passport or other document certifying his identity;
– Vehicle for inspection.
After performing these actions, the Parking Administration provides the Car Owner with a Parking Pass, which does not assign a specific parking space to the Car Owner. The Car Owner has the right to place his car in all free parking spaces indicated by the Parking staff.
4.1.2. When the Car Owner receives the Parking Pass, the Car Owner must familiarize himself with the Parking Activity Regulations, and also make a payment for the Parking Pass.
4.1.3. Car Owners who have not paid or extended the Parking Pass on time lose the right to use the Parking services.
4.1.4. In the event of the purchase of another Vehicle by the person who purchased the Parking Pass, this person has the right to continue using the Parking Pass, and must notify the Parking Administration about the replacement of the Vehicle, and reissue the Parking Pass according to the order of the Parking Administration.
4.1.5. The Parking Administration has the right to terminate the use of the Parking Pass by the Car Owner early in the following cases:
– if the Car Owner has declared the termination of use of the Parking;
– the Car Owner has violated the requirements of these Regulations;
– if the Car Owner has not made payment for the Parking Pass without good reason or for other reasons.
4.1.6. In the event of the closure of the Parking, incl. for repairs and (or) any other circumstances that led to a reduction in the number of parking spaces, as well as in the event of a violation by the Car Owner of the requirements of these Regulations, the Parking Administration has the right to terminate the Parking Pass at any time, notifying the Car Owner of this by phone call, who is obliged to remove his Vehicle from the Parking within 2 days.
4.1.7. If the Car Owner has not removed his Vehicle from the Parking within 2 days after receiving the notification of the termination of the Parking Pass, the Parking Administration has the right to contact the police with a corresponding request for the evacuation of the Vehicle to special sites.
4.1.8. When leaving the Parking of the Vehicle after the expiration of its placement period, the Car Owner is obliged to:
– hand over the Parking Pass to the Parking employee;
– make an entry in the registration card about the termination of the Parking use with a personal signature and the date of the entry.
4.1.9. For the loss of the Parking Pass, the Car Owner shall be charged a fine of UAH 200.00.
4.2. Use of Parking services upon receipt of a Parking Ticket
4.2.1. Placement of Vehicles in the Parking area on the basis of a Parking Ticket is carried out without assigning them parking spaces in parking spaces free from placement, indicated by the Parking staff.
4.2.2. Upon entering the Parking, the Car Owner, by pressing the receipt button at the entry counter, receives a Parking Ticket, which records the time of entry of the Vehicle into the Parking.
4.2.3. Parking tickets of the established sample are documents for a short-term stay of Vehicles in the Parking, as well as passes for entering and exiting the Parking.
4.2.4. In advance, before leaving the Parking Lot, the Car Owner, based on the issued Parking Ticket, makes a payment at the parking meter by non-cash or cash payment with receipt of a fiscal check, in the mobile application or immediately before leaving by contactless payment method through the check-out system located at the parking lot exit counter for the actual time the Vehicle is in the Parking Lot.
4.2.5. Vehicles that have been damaged as a result of an accident are not allowed into the Parking Lot for short-term placement.
4.2.6. Vehicles with a damaged or dirty front license plate are not allowed into the Parking Lot.
4.2.7. If the Parking Ticket is lost or the Vehicle’s license plate is damaged or soiled, the Car Owner is obliged to pay a fine of 200 UAH for searching for information to exit the Vehicle, and to pay for the entire time spent in the parking lot, determined according to the ASUP software, which is paid to the Parking Administration by the Car Owner.
5. Parking space usage fee.
5.1. Parking space usage fee and other services provided in the Parking Lot are charged at the rates established by the Parking Lot Administration.
5.2. Parking space usage fee is charged:
5.2.1. – for long-term placement of the Vehicle on the basis of a Parking Pass – according to the rates specified in clause 2.1. of these Regulations;
5.2.2. – for short-term placement of the Vehicle on the basis of a Parking Ticket upon exiting the Parking Lot for the actual time of the Vehicle’s stay, according to the tariffs specified in clause 2.1. of these Regulations, when paying at the Parking Lot parking machine by non-cash or cash payment with receipt of a fiscal check and when paying via a mobile application.
5.3. For short-term placement of the Vehicle in the Parking Lot, the fee for using the parking space is calculated hourly, and if the Vehicle is in the Parking Lot for more than the full first hour, the payment for the next second hour is charged in full.
5.4. The period of free use of the parking space is 30 (thirty) minutes of the Vehicle’s stay in the Parking Lot. This period is calculated from the moment of receiving the Parking Ticket upon entering the Parking Lot until the moment the Vehicle leaves the Parking Lot. If the Vehicle does not leave the Parking area during this period, the Car Owner will be charged a fee for a full hour.
5.5. In the event of a short-term placement of the Vehicle in the Parking Area, the Car Owner, who has exceeded the established placement period (more than 1 day), the Parking Administration has the right to apply to the police with a corresponding application for the evacuation of the Vehicle to special sites, with subsequent collection from the Car Owner of the fee for using the parking space for the entire time the Vehicle is in the Parking Area.
5.6. When paying for the Parking Ticket at a parking meter, the Car Owner is obliged to leave the Parking Area within 30 minutes. If the Vehicle has not left the Parking Area within 30 minutes after paying for the Parking Ticket, in this case the automated Parking Management System continues to charge the Parking fee according to the established tariff.
6. Rights and Obligations of Car Owners
6.1. Car Owners retain the right to long-term and short-term placement of Vehicles in the Parking, provided that they comply with the requirements of these Regulations and timely pay the established (contractual) tariffs for using the Parking, specified in clause 2.1.2. of these Regulations.
6.2. Entry to the Parking area is allowed only to the Car Owner or his authorized person under valid Subscriptions or Parking Tickets.
6.3. The doors, hood and trunk of Vehicles located in the Parking must be locked.
The Vehicle in the Parking remains in neutral gear and not on the parking (hand) brake and is fixed against arbitrary movement or with a locking shoe. If there is an alarm, the alarm is turned on, and if there is no alarm, the negative battery wire (ground) must be disconnected.
6.4. When using the Parking, Car Owners are obliged to:
– strictly comply with the requirements of these Regulations, the rules of safety and fire safety, and sanitary standards;
– maintain cleanliness and order in the Parking, do not wash the Vehicle;
– keep the Vehicle clean and ensure that there are no leaks of roadway, antifreeze, fuel, and other technical fluids used in Vehicles from the Vehicle; in the event of leakage of fuel and lubricants and coolant, the Car Owner shall pay a fine of UAH 500 to the Parking Administration;
– comply with the Traffic Rules;
– do not leave children unattended in the Parking area;
– do not obstruct other Vehicles moving through the Parking area with their actions;
– briefly familiarize passengers in the Vehicle with the requirements of these Regulations;
– upon request of a Parking employee, present the Vehicle for inspection upon entering the Parking;
– not transfer valid Subscriptions and/or Parking Tickets to other persons;
– in the event of liquidation of the Parking, upon expiration of the term of use of the Parking, as well as upon loss of the right to use the Parking, remove your Vehicle from the Parking;
– when placing several Vehicles in the Parking, pay for the placement of each Vehicle;
– when placing a Vehicle in the Parking, leave a fire extinguisher and a tow rope in the cabin;
– pay for parking the Vehicle on time at the established rates and, upon request of Parking employees, present them with documents confirming payment for parking the Vehicle.
– in the event of causing damage to the Parking and Vehicles located on the Parking territory by your actions, compensate for the damage in full;
– the maximum permissible speed of vehicles on the territory of the Parking (speed limit) is 5 km / h;
– upon entering the Parking, the Car Owner is obliged to clean the front license plate of the Vehicle from snow and dirt.
7. In the Parking it is prohibited to:
7.1. – perform maintenance and repair of Vehicles, wash them, refuel with gasoline and oil, use open fire to warm up engines and units;
– drive the Vehicle at a speed of more than 5 km/hour;
– smoke, consume, use tobacco products, electronic cigarettes, devices for consuming tobacco products without burning them, hookahs,
– drink alcoholic beverages, be in the Parking in a drunken state or under the influence of narcotic substances;
– store explosive materials in the luggage compartment or interior of the Vehicle;
– install any cabinets or drawers for storing fuel, spare parts, inventory, trench tools, etc.;
– tow the Vehicle for starting it;
– install the Vehicle on trestles, stands and other objects;
– leave the Vehicle with the gearshift engaged, on the parking (hand) brake;
– carry out work under the Vehicle mounted on a jack;
– use any means of covering the Vehicle, such as car covers (capes), including those of industrial manufacture. State license plates and wheels of the Vehicle must be open for inspection;
– parking in non-designated places, on pedestrian paths and on loading and unloading areas of the Parking (Ramps);
– park cars in places for charging electric vehicles;
– charge electric vehicles in places not designated for this;
– use the Parking for a purpose other than parking.
7.2. For violation of the requirements of clause 7.1 of these Regulations, the Parking Administration has the right to impose a fine on the Car Owner in the amount of 200.00 hryvnias excluding VAT for each such violation.
7.3. The Parking has limited entry:
Parking of Vehicles with the following characteristics is permitted only in specially designated places marked with appropriate markings:
– the height of the Vehicle exceeds 2.3 m;
– the width of the Vehicle exceeds 2 m;
– the length exceeds 5.3 m;
– the ground clearance is less than 120 mm;
– bicycles, roller skates, unicycles, scooters, electric scooters, skateboards, gyro scooters, vehicles with trailers, etc.
8. The Administration undertakes to:
8.1. – equip the Parking with road signs, apply markings in accordance with the current legislation of Ukraine;
– maintain in working order and monitor the serviceability of the parking equipment;
– clean the Parking area from snow, ice and household garbage;
– in the event of creating any obstacle, take all possible measures to eliminate it, and if this is impossible, then use available means to ensure that other Car Owners are informed about the danger.
9. Use of Parking for Persons with Disabilities
9.1. In accordance with Article 30 of the Law of Ukraine “On the Fundamentals of Social Protection of Persons with Disabilities in Ukraine” and the Resolution of the Cabinet of Ministers of Ukraine No. 585 dated May 25, 2011 “On Approval of the Procedure for Providing Benefits to Drivers with Disabilities, Drivers Transporting Persons with Disabilities, Including Vehicles Owned by Public Organizations with Disabilities, Enterprises, Institutions, and Organizations Operating in the Field of Social Protection of the Population, for Free Parking and Storage of Vehicles” – all categories of persons with disabilities have the right to use Parking services free of charge.
9.2. On the territory of the Parking there are specially designated parking spaces for parking a Vehicle in which a person with disabilities is located, only if such a person has a corresponding certificate.
9.3. A vehicle with a sign marked “Person with a disability” and in which such a person is not present at the time of entry to the Parking Lot cannot use the Parking Lot services free of charge.
9.4. Entry to the Parking Lot territory by a person with a disability is carried out only through a barrier. When leaving the Parking Lot, a person with a disability shall contact the Parking Lot employees and present a document confirming disability.
A Parking Lot employee shall take a photo of such a document before the person with a disability leaves the Parking Lot. Such a Vehicle shall leave the Parking Lot territory free of charge.
