1. General Provisions
1.1. These Regulations on Parking Activities (hereinafter referred to as the “Regulations”) define a single procedure for organizing and operating the Parking in order to ensure proper conditions for Car Owners when using Parking services.
The Regulations regulate the relationship between the Parking Administration (Limited Liability Company “Misto Park Service”, EDRPOU code 43133921) and the owners of Vehicles (hereinafter referred to as the “Car Owner”) who use the services of multi-level parking, namely: underground, indoor, open parking, which are located in the RIVER MALL shopping and entertainment center at the address: Kyiv, Dniprovska naberezhna, building No. 12 (hereinafter referred to as the “Parking”).
These Regulations are a public agreement within the meaning of Art. Art. 633, 641 of the Civil Code of Ukraine, their terms are the same for all Car Owners, regardless of their status (individual, legal entity, individual entrepreneur. The subject of this public agreement is the provision by the Parking Administration of Services for placing Vehicles in the Parking and the fulfillment of the terms of these Rules by the Car Owners. The public agreement comes into force from the moment of Acceptance of the offer and is valid until its full fulfillment.
In accordance with Part 2 of Article 642 of the Civil Code of Ukraine, the entry of the Car Owner by Vehicle into the Parking area is an acceptance of the offer to conclude an agreement for the provision of services for placing Vehicles in the Parking area (acceptance of the offer) and certifies the Car Owner’s desire to conclude this agreement and confirms the Car Owner’s consent to comply with the Parking Use Rules set out below.
From the moment of entry by the Vehicle into the Parking area, the Car Owner fully accepts the terms specified in the Regulations, including tariffs for the use of Parking Spaces, sizes losses that the Car Owner is obliged to compensate in favor of LLC “Misto Park Service” in the event of damage caused by the Car Owner in the amount set out in Appendix No. 1 to the Regulations, and all other terms of the Rules.
1.2. The main terms used in these Regulations:
1.2.1. Placement of Vehicles – temporary location of a Vehicle in the Parking area. Vehicle storage services are not provided on the Parking lot.
1.2.2. Parking space – a place in the Parking area for placing one Vehicle, limited by marking contours with a corresponding serial number.
1.2.3. Payment for the use of a parking space – a mandatory payment made by Car Owners for using Parking services, according to the tariffs determined by the Parking Administration.
1.2.4. Vehicles – passenger cars, minibuses, motorcycles, scooters, trailers and others.
1.2.5. Car Owners – owners and users of Vehicles, whose right to ownership or use is confirmed by relevant documents.
1.2.6. Persons with disabilities are persons with disabilities who have an appropriate document certifying the right to free parking of a Vehicle, who have an appropriate certificate of a recipient of state social assistance paid instead of a pension, or a certificate of a person receiving state social assistance in accordance with the Law of Ukraine “On State Social Assistance to Persons with Disabilities from Childhood and Children with Disabilities”, or a certificate for receiving benefits by persons with disabilities who are not entitled to a pension or social assistance, which contains a record of disability.
1.2.7. Parking Administration – a legal entity authorized by the Parking Owner that carries out commercial operation of the Parking on the basis of a concluded lease agreement.
1.2.8. Parking Employees – employees authorized by the Parking Administration who perform work on the provision of services for the placement of Vehicles, maintenance of the Parking and provide other services.
1.2.9. Parking Pass – a fixed-term document (plastic card) certifying the conclusion of an agreement between the Parking Administration and the Car Owner for the use of the Parking, the fact of payment by the Car Owner to the Parking Administration for the use of a parking space, and is confirmation of the right to stay the Vehicle in the Parking, access to the Parking.
1.2.10. Parking Ticket – a document certifying the conclusion of an agreement between the Parking Administration and the Car Owner for the use of the Parking, is a one-time pass for entry and exit from the Parking and records the date and time of the start of using the Parking. Receiving a Parking Ticket certifies the Car Owner’s agreement with these Regulations.
1.2.11. Parking Usage Period – the period for using the Parking, which is calculated from the moment of receiving the Parking Ticket upon entering the Parking, until the moment of payment for using the Parking at the parking meter or mobile application before leaving the Vehicle from Parking. The term of use of the Parking based on the Parking Pass is calculated from the moment of payment for the Pass and is valid for one month.
1.2.12. Loading and unloading area of the Parking (Ramp) – a zone specially designated by the Parking Administration or the SEC Administration, which is marked with markings on the Parking territory and is used for loading and unloading
2. Tariffs for using Parking services
2.1. The Car Owner uses the Parking under the following tariffs and conditions:
1. Parking ticket – “Standard”
– Upon entering the Parking area, 30 minutes are provided to the Car Owner free of charge
– Motorcycles, mopeds, motorized strollers 5 hours free of charge
– Each subsequent hour 50.00 UAH.
2. Parking ticket – “Daily”
Staying the Car Owner’s Vehicle in the Parking from 14 hours to 24 hours 700.00 UAH.
3. Parking Pass “Without restrictions”
The Car Owner uses Parking services for one month
7,000.00 UAH.
3. Organization of Parking Operation
3.1. On the territory of the Parking, in a prominent place, these Regulations, the Parking schedule, information on tariffs for Parking services, fire safety rules and safety equipment, a Parking plan indicating the direction of movement of Vehicles, an emergency evacuation plan for Vehicles, telephone numbers of the Parking Administration, state bodies for consumer protection, police, fire department, ambulance, a book of complaints and suggestions, samples of documents for using the Parking are placed.
3.2. The Parking Administration is obliged to provide the Car Owner with convenient conditions for placing the Vehicle.
3.3. For the convenience of Car Owners, an automated system for recording and controlling the entry and exit of Vehicles has been introduced in the Parking.
3.4. Placing Vehicles in the Parking is carried out around the clock.
3.5. Vehicles that are registered in accordance with the current legislation of Ukraine (or any other country that does not contradict the legislation of Ukraine) and have a state license plate are accepted for the Parking.
It is strictly forbidden to accept a Vehicle into the Parking for any period without a state license plate!!!
3.6. The Parking Administration is not responsible for the safety of the Vehicle, its completeness and the safety of the property located in it.
3.7. Entry to the Parking area is carried out only through the barrier, near which there is a counter where the Car Owner receives a Parking Ticket or applies a Parking Pass for reading. Exit from the Parking is carried out through the barrier.
4. Using Parking services
4.1. Using Parking services when receiving a Parking Pass
4.1.1. When registering as a Parking Passholder, the Car Owner must present to the responsible Parking employee:
– technical passport (technical passport) of the Vehicle;
– passport or other document certifying his identity;
– Vehicle for inspection.
After completing these steps, the Parking Administration provides the Car Owner with a Parking Pass, which does not assign a specific parking space to the Car Owner. The Car Owner has the right to park his car in all free parking spaces indicated by the Parking staff.
4.1.2. Upon receipt by the Car Owner of the Parking Pass, the Car Owner must familiarize himself with the Parking Operation Regulations, and also make a payment for the Parking Pass.
4.1.3. Car Owners who have not paid or extended the Parking Pass on time lose the right to use the Parking services.
4.1.4. In the event of the purchase of another Vehicle by the person who purchased the Parking Pass, this person has the right to continue using the Parking Pass, and must notify the Parking Administration of the replacement of the Vehicle, and reissue the Parking Pass by order of the Parking Administration.
4.1.5. The Parking Administration has the right to terminate the use of the Parking Pass by the Car Owner early in the following cases:
– if the Car Owner has declared the termination of use of the Parking;
– violation by the Car Owner of the requirements of these Regulations;
4.1.6. In the event of the closure of the Parking Lot, including for repairs and (or) any other circumstances that led to a reduction in the number of parking spaces, as well as in the event of a violation by the Car Owner of the requirements of these Regulations, the Parking Lot Administration has the right to terminate the Parking Pass at any time, notifying the Car Owner of this by phone call, who is obliged to remove his Vehicle from the Parking Lot within 2 days.
4.1.7. In the event that the Car Owner has not removed his Vehicle from the Parking Lot within 2 days after receiving the notification of the termination of the Parking Pass, the Parking Lot Administration has the right to contact the police with a corresponding request for the evacuation of the Vehicle to special sites.
4.1.8. When leaving the Parking Lot after the expiration of its placement period, the Car Owner is obliged to:
– hand over the Parking Pass to the Parking Lot employee;
– make an entry in the registration card about the termination of use of the Parking under a personal signature with the date of entry.
4.1.9. For the loss of the Parking Pass, a fine of 200.00 hryvnias shall be charged to the Car Owner.
4.2. Use of Parking services upon receipt of a Parking Ticket
4.2.1. Placement of Vehicles in the Parking area on the basis of a Parking Ticket is carried out without assigning them parking spaces in parking spaces free from placement, indicated by the Parking staff.
4.2.2. Upon arrival at the Parking, the Car Owner, by pressing the receipt button at the entrance counter, receives a Parking Ticket, which records the time of arrival of the Vehicle in the Parking.
4.2.3. Parking tickets of the established sample are documents for the short-term stay of Vehicles in the Parking, as well as passes for entering and leaving the Parking.
4.2.4. In advance, before leaving the Parking Lot, the Car Owner, based on the issued Parking Ticket, makes a payment at the parking meter by cashless or cash payment with receipt of a fiscal check, in the mobile application or immediately before leaving by contactless payment method through the check-out system located at the parking lot exit counter for the actual time the Vehicle is in the Parking Lot.
4.2.5. Vehicles that have been damaged as a result of an accident are not allowed in the Parking Lot for short-term placement.
4.2.6. A vehicle with a damaged or dirty front license plate is not allowed in the Parking Lot.
4.2.7. A vehicle with a damaged or dirty front license plate is not allowed in the Parking Lot.
If the Parking Ticket is lost or the Vehicle license plate is damaged or soiled, the Car Owner is obliged to pay a fine of UAH 200 for searching for information to exit the Vehicle and to pay for the entire time spent in the parking lot, determined according to the ASUP software, which is paid to the Parking Administration by the Car Owner.
5. Parking space usage fee.
5.1. Parking space usage fee and other services provided in the Parking are charged at the rates established by the Parking Administration.
5.2. Parking space usage fee is charged:
5.2.1. – for long-term placement of the Vehicle on the basis of a Parking Pass – according to the rates specified in clause 2.1. of these Regulations;
5.2.2. – for short-term placement of the Vehicle on the basis of a Parking Ticket upon leaving the Parking for the actual time of the Vehicle’s stay, according to the rates specified in clause 2.1. of these Regulations, when paying at the Parking machine by cashless or cash payment with receipt of a fiscal check and when paying via a mobile application.
5.3. In the case of short-term parking of the Vehicle in the Parking Lot, the fee for using the parking space is calculated hourly, and if the Vehicle is in the Parking Lot for more than the full first hour, the fee for the next second hour is charged in full.
5.4. The period of free use of the parking space is 30 (thirty) minutes of the Vehicle being in the Parking Lot. This period is calculated from the moment of receiving the Parking Ticket upon entering the Parking Lot until the moment the Vehicle leaves the Parking Lot. If the Vehicle does not leave the Parking Lot during this period, the Car Owner is charged a fee for a full hour.
5.5. In the event of a short-term placement of a Vehicle in the Parking Lot by a Car Owner who has exceeded the established placement period (more than 1 day), the Parking Administration has the right to apply to the police with a corresponding request to evacuate the Vehicle to special sites, with subsequent collection from the Car Owner of the fee for using the parking space for the entire time the Vehicle is in the Parking Lot.
5.6. When paying for a Parking Ticket at a parking meter, the Car Owner is obliged to leave the Parking Lot territory within 30 minutes. If the Vehicle has not left the Parking Lot territory within 30 minutes after paying for the Parking Ticket, in this case the automated Parking Lot management system continues to charge the Parking fee according to the established tariff.
6. Rights and obligations of Car Owners
6.1. Car Owners retain the right to long-term and short-term placement of Vehicles in the Parking, provided that they comply with the requirements of these Regulations and timely pay the established (contractual) tariffs for using the Parking, specified in clause 2.1.2. of these Regulations.
6.2. Entry to the Parking area is allowed only to the Car Owner or his authorized person under valid Subscriptions or Parking Tickets.
6.3. The doors, hood and trunk of Vehicles located in the Parking must be locked.
The Vehicle in the Parking remains in neutral gear and not on the parking (hand) brake and is fixed against arbitrary movement or with a locking shoe. If there is an alarm, the alarm is turned on, and if there is no alarm, the negative battery wire (ground) must be disconnected.
6.4. When using the Parking, Car Owners are obliged to:
– strictly comply with the requirements of these Regulations, the rules of safety and fire safety, and sanitary standards;
– maintain cleanliness and order in the Parking, do not wash the Vehicle;
– keep the Vehicle clean and ensure that there are no leaks of roadway, antifreeze, fuel, and other technical fluids used in Vehicles from the Vehicle; in the event of leakage of fuel and lubricants and coolant, the Car Owner shall pay a fine of UAH 500 to the Parking Administration;
– comply with the Traffic Rules;
– do not leave children unattended in the Parking area;
– do not obstruct other Vehicles moving through the Parking area with their actions;
– briefly familiarize passengers in the Vehicle with the requirements of these Regulations;
– upon request of a Parking employee, present the Vehicle for inspection upon entering the Parking;
– not transfer valid Subscriptions and/or Parking Tickets to other persons;
– in the event of liquidation of the Parking, upon expiration of the term of use of the Parking, as well as upon loss of the right to use the Parking, remove your Vehicle from the Parking;
– when placing several Vehicles in the Parking, pay for the placement of each Vehicle;
– when placing a Vehicle in the Parking, leave a fire extinguisher and a tow rope in the cabin;
– pay for parking the Vehicle on time at the established rates and, upon request of Parking employees, present them with documents confirming payment for parking the Vehicle.
– in the event of causing damage to the Parking and Vehicles located on the Parking territory by your actions, compensate for the damage in full;
– the maximum permissible speed of vehicles on the territory of the Parking (speed limit) is 5 km / h;
– upon entering the Parking, the Car Owner is obliged to clean the front license plate of the Vehicle from snow and dirt.
7. In the Parking it is prohibited to:
7.1.
– perform maintenance and repair of Vehicles, wash them, refuel with gasoline and oil, use open fire to warm up engines and units;
– drive the Vehicle at a speed of more than 5 km/hour;
– smoke, consume, use tobacco products, electronic cigarettes, devices for consuming tobacco products without burning them, hookahs,
– drink alcoholic beverages, be in the Parking in a drunken state or under the influence of narcotic substances;
– store explosive materials in the luggage compartment or interior of the Vehicle;
– install any cabinets or drawers for storing fuel, spare parts, inventory, trench tools, etc.;
– tow the Vehicle for starting it;
– install the Vehicle on trestles, stands and other objects;
– leave the Vehicle with the gearshift engaged, on the parking (hand) brake;
– carry out work under the Vehicle mounted on a jack;
– use any means of covering the Vehicle, such as car covers (capes), including those of industrial manufacture. State license plates and wheels of the Vehicle must be open for inspection;
– parking in non-designated places, on pedestrian paths and on loading and unloading areas of the Parking (Ramps);
– park cars in places for charging electric vehicles;
– charge electric vehicles in places not designated for this;
– use the Parking for a purpose other than parking.
7.2. For violation of the requirements of clause 7.1 of these Regulations, the Parking Administration has the right to impose a fine on the Car Owner in the amount of 200.00 hryvnias excluding VAT for each such violation.
7.3. Entry to the Parking is restricted:
Parking of Vehicles with the following characteristics is permitted only in specially designated places marked with appropriate markings:
– Vehicle height exceeds 2.3 m;
– Vehicle width exceeds 2 m;
– Length exceeds 5.3 m;
– Ground clearance (clearance) less than 120 mm;
– Bicycles, rollerblades, unicycles, scooters, electric scooters, skateboards, gyro scooters, vehicles with trailers, etc.
8. The Administration undertakes to:
8.1.
– equip the Parking with road signs, apply markings in accordance with the current legislation of Ukraine;
– maintain in working order and monitor the serviceability of the parking equipment;
– clean the Parking area from snow, ice and household garbage;
– in the event of any obstacle being created, take all possible measures to eliminate it, and if this is impossible, then use available means to inform other Car Owners about the danger.
9. Use of the Parking by persons with disabilities
9.1. In accordance with Article 30 of the Law of Ukraine “On the Fundamentals of Social Protection of Persons with Disabilities in Ukraine” and the Resolution of the Cabinet of Ministers of Ukraine No. 585 dated May 25, 2011 “On Approval of the Procedure for Providing Benefits to Drivers with Disabilities, Drivers Carrying Persons with Disabilities, Including Vehicles Owned by Public Organizations with Disabilities, Enterprises, Institutions, and Organizations Operating in the Field of Social Protection of the Population, for Free Parking and Storage of Vehicles” – all categories of persons with disabilities have the right to free PARKING of vehicles. Free parking is carried out by placing the vehicle in a free parking space, taking into account road signs and road markings.
For free use of the Parking, check-in and check-out must take place within 14 hours. If a Vehicle driven by disabled drivers or drivers transporting disabled persons does not leave the Parking Lot within 14 hours, the tariff established by subparagraph 2 of clause 2.1 of the Regulations shall apply.
9.2. There are specially designated parking spaces on the Parking area for parking a Vehicle in which a person with disabilities is located, only if such a person has a corresponding certificate.
9.3. A vehicle on which a sign with the inscription “Person with Disabilities” is located, and in which such a person is not located at the time of entry to the Parking, cannot use Parking services free of charge.
9.4. Entry to the Parking area by a person with a disability is carried out only through the barrier. When leaving the Parking area, a person with a disability shall contact the Parking staff and present a document confirming disability.
A Parking employee shall take a photo of such a document before the person with a disability leaves the Parking area. Such a Vehicle shall leave the Parking area free of charge.
9.5. Free storage of vehicles of persons with disabilities is possible exclusively in accordance with the procedure stipulated by the Resolution of the Cabinet of Ministers of Ukraine No. 585 of May 25, 2011 “On approval of the Procedure for granting privileges to drivers with disabilities, drivers transporting persons with disabilities, including vehicles belonging to public organizations with disabilities, enterprises, institutions, organizations engaged in social protection of the population, for free parking and storage of vehicles.”

The purpose of the RIVER MALL Shopping and Entertainment Center (hereinafter referred to as the Shopping Center) is to ensure maximum comfort for visitors.
• The Shopping and Entertainment Center is open to visitors every day (Shopping Center Hours):
Shopping Center: from 10:00 to 22:00
Silpo: from 09:00 to 23:00
Planeta Kino: from 10:00 to the last session
• The Shopping Center Administration has the right to establish and change the Shopping Center Hours, close the Shopping Center or restrict access to the Shopping Center in order to ensure fire, public safety, safety in an emergency, as well as in weather conditions, for technological, technical, operational, sanitary and hygienic, organizational and other reasons that pose a threat to the life or health of people or cause damage to property.
• All relations between the Shopping Center Administration and business structures operating on the territory of the Shopping Center are regulated by the current legislation of Ukraine.
• The Mall Administration is not responsible for the quality of goods and/or services provided by entrepreneurs – tenants of the Mall.
• The Mall Administration is not responsible for the safety of items left in the cloakroom and other common areas of the Mall.
• Periodically, the Mall Administration holds mass events to promote the Mall with photo and video recording of such events. By staying in the Mall, the Visitor gives his consent to photographing and video recording both him personally and minor/young members of his family, as well as his animals, within the framework of such events. By staying in the shopping center, the Visitor also gives his/her unconditional consent to the free use of photo and video materials taken in the shopping center, which contain his/her image and/or images of minors/young members of his/her family, when creating advertising, information messages about the activities of the shopping center and for other purposes related to the activities of the shopping center, and also gives his/her consent to the storage, reproduction, distribution and processing of the specified photo and video materials.
Taking care of the comfort and safety of visitors, as well as in order to maintain order in the shopping center, the Administration asks to adhere to the following rules:
1. Visitors to the shopping center are obliged to:
1.1. Before visiting the shopping center, independently and in detail familiarize themselves with these Rules, which are posted on the official website at: https://rivermall.ua/, as well as at the shopping center information desk;
1.2. Treat the shopping center property with care, prevent its damage, maintain greenery, maintain cleanliness and order, be neatly dressed, and be attentive to other visitors;
1.3. Observe public order, traffic rules in the area adjacent to the shopping center, fire safety rules, and fulfill reasonable requirements of the Administration and the Shopping Center Security Service.
1.4. During the period of the relevant quarantine restrictions established by the current legislation of Ukraine and/or by the decision of local authorities, enter the shopping mall and stay in the shopping mall at all times wearing personal protective equipment (PPE), in particular a respirator or a protective mask covering the nose and mouth, including those made independently. The shopping mall security service has the right to deny entry to a visitor without PPE or to ask them to leave the shopping mall. If a visitor without PPE does not comply with the request of the shopping mall security service, the latter has the right to call the police.
1.5. In emergency situations related to natural phenomena, riots, military operations, accidents, criminal acts of third parties, etc., visitors must strictly follow the instructions and instructions of the shopping mall administration.
1.6. During an air alarm, listen to the announcements made from the loudspeakers in the shopping mall.
2. The following are not allowed on the territory of the shopping center and the territory adjacent to the shopping center:
2.1. Entry and riding on roller skates, bicycles, skateboards, scooters, electric scooters, gyro scooters, etc.;
2.2. Entry with animals into public areas without observing the Rules for Keeping Domestic Dogs and Cats in Kyiv (hereinafter referred to as the Rules for Keeping Domestic Animals), approved by the decision of the Kyiv City Council dated 25.10.2007 No. 1079/3912, namely:
2.2.1. The person accompanying the animal is obliged to ensure the safety of the accompanied animal, surrounding people and animals, as well as property from causing harm by the accompanied animal.
2.2.2. The person accompanying the animal is obliged to comply with sanitary and hygienic standards and public order, and to clean up the excrement of their animals.
2.2.3. Dogs may be kept in the common areas of the shopping mall only on a leash, and potentially dangerous dog breeds, the list of which is established by the appendix to the Rules for Keeping Pets, must be kept on a short leash (no longer than 1.2 m) and in a muzzle;
2.2.4. Entrance to the shops of the shopping mall tenants is regulated by the tenant’s internal rules.
2.3. Smoking, consumption, use of tobacco products, electronic cigarettes, devices for consuming tobacco products without burning them, hookahs, except for specially designated places in the territory adjacent to the shopping mall;
2.4. Consumption of alcoholic beverages outside the relevant establishments;
2.5. Taking photos and videos without the consent of the SEC Administration, with the exception of “Selfies” and photos for personal purposes, which are taken using mobile phones and (or) amateur cameras or video cameras, if the person taking the photos and videos does not create inconvenience to other SEC Visitors and does not violate public order;
2.6. Carrying out any activity without the written consent of the SEC Administration (including, but not limited to, the sale, distribution and posting of advertising brochures, flyers, advertisements, organizing gatherings and performances of artists, holding concerts and flash mobs);
2.7. Using obscene expressions in language, speaking in a raised tone, committing actions that offend the honor and dignity of other Visitors;
2.8. Carrying flammable, explosive, poisonous, pyrotechnic, flammable and radioactive substances, firearms and cold weapons, gas weapons and ammunition, electric shock devices, mechanical or automatic aerosol sprayers of all types;
2.9. Rearranging furniture without the permission of the Mall Administration;
2.10. Throwing garbage outside specially designated places;
2.11. Blocking entrances, passages and evacuation exits;
2.12. Parking cars outside specially designated places.
2.13. Spoiling, damaging the Mall property;
2.14. Leaving bags, belongings and other items unattended.;If forgotten, ownerless items are discovered, the Customer must immediately inform the Mall Administration or the Mall Security Service. Before the Mall employees arrive, it is prohibited to independently carry out any actions with the discovered item.
2.15. Behavior that may offend or disturb other visitors.
2.16. Children under 12 years of age staying in the shopping mall without adult supervision. The security service has the right to prevent children under 12 years of age from entering the shopping mall without adult supervision;
2.17. Playing musical instruments in the shopping mall, using sound and video playback devices (except personal ones) without the approval of the Administration;
2.18. Turning on and listening to loud music;
2.19. Leaving children without adult supervision;
2.20. Eat food outside the food court, restaurant, or cafe areas; carry hot food and drinks around the shopping center (including in elevators and escalators) (except for carrying in hermetically sealed containers/packaging);
2.21. Go behind the fences of repair or other types of work;
2.22. Beg;
2.23. Stop or block automatic revolving doors, delay the entry/exit of other visitors, and allow more than three people to enter one compartment;
2.24. Run, run on escalators, move on an escalator against traffic, jump, climb fences, railings, technical structures, jump from any height, lean over railings, enter service premises, as well as other restricted access areas decorated with appropriate information boards, signs, and pointers;
2.25. Enter restrooms during cleaning;
2.26. Use restrooms for purposes other than their intended purpose;
2.27. Touch, move inventory, decorations, Christmas tree decorations, elements of the shopping center decor, any electrical equipment not intended for games and entertainment;
2.28. Enter the shopping center with oversized items, which include items that exceed 180 cm in the sum of three dimensions, except for goods purchased in retail establishments on the territory of the shopping center;
2.29. Use radio-controlled equipment (cars, helicopters, quadcopters, etc.);
2.30. Make a bonfire, light candles or otherwise use open fire;
2.31. Sell and (or) demonstrate pornographic products, products of extremist content;
2.32. Organize and conduct gambling on the territory of the shopping center and participate in them.
3. The following persons are not allowed to be on the territory of the shopping center and the adjacent territory:
3.1. Intoxicated or under the influence of narcotic substances;
3.2. Persons who violate public order, engage in begging;
3.3. Persons who threaten the safety of visitors to the shopping center;
3.4. Persons in dirty clothes, persons from whom an unpleasant odor is heard;
3.5. Persons who are in the shopping mall without clothes, with a bare torso, or whose appearance offends human dignity and is clearly incompatible with generally accepted norms of social behavior;
3.6. Persons who have previously grossly or repeatedly violated the requirements of these Rules.
All of the above persons are required to immediately leave the shopping mall at the request of the shopping mall security staff.
4. Access to the shopping mall
4.1. Journalists, in order to carry out their professional activities on the territory of the shopping mall, other persons who wish to carry out photo and video shooting, cover events, prepare photo and video stories on the territory of the shopping mall submit applications to the Administration for obtaining the appropriate permit. Having issued the necessary permit, journalists, other persons, in accordance with the purpose specified in the application, may carry out the appropriate activity in the agreed place of the shopping mall.
The shopping mall security service has the right to ask to show the permission from the Administration to carry out the above-mentioned activity on the territory of the shopping mall. In the absence of this permit, a representative of the shopping mall security service informs the person about the prohibition of carrying out such activity in the shopping mall without the permission of the Administration and the need to stop the activity, except for cases when the implementation of such activity is expressly permitted by law.
5. Responsibility for violation of the shopping mall rules
5.1. Visitors who have violated the requirements of these Rules, as a result of which their actions (inaction) have caused property damage to the Shopping Center, the Building Owner and (or) other Visitors, may be held civilly liable in order to compensate for the losses caused in accordance with the procedure established by the current legislation of Ukraine.
5.2. Visitors who have violated the requirements of these Rules and whose actions show signs of an administrative offense or a criminal offense may be held, respectively, administratively or criminally liable in accordance with the current legislation of Ukraine.
5.3. The Administration has the right to take all lawful measures aimed at bringing the guilty persons to the appropriate civil (material), administrative and (or) criminal liability.
6. Lost items
6.1. In case of loss or finding (discovery) of any item left by an unknown person, the Visitor must contact the Security Service or the SEC Administrators at the Info Desk or call tel.: +380(67) 357-67-67 during the SEC’s working hours.
6.2. The Security Service employee has the right to open and inspect the contents of the found items or invite police officers for the specified purposes.
6.3. The Administrator returns the lost item to the Visitor subject to prior receipt from the Visitor of confirmation that the item belongs to the Defendant (providing relevant documents, correct description of the item or its contents, etc.). Before transferring valuables to their owner, a document is drawn up recording such transfer, which must include the Visitor’s passport data.
6.4. If no one comes to claim the found item within two months, the Administration reserves the right to dispose of it at its discretion, including handing it over for disposal.
These Rules of Conduct apply to all visitors to the territory of the embankment of the RIVER MALL shopping center (hereinafter referred to as the shopping center), located on the land plot at the address: Kyiv, Dniprovska embankment, 14 (hereinafter referred to as the Embankment), as well as drivers of river vehicles and other water vehicles entering the water area adjacent to the Embankment and which is in use by LLC “IA “VILNA UKRAINA” on the basis of a lease agreement dated 03.06.2005.
These Rules of Conduct have been developed in accordance with the requirements of the current legislation of Ukraine.
1. GENERAL PROVISIONS
1.1. Visitors are obliged to be mutually polite, to treat property, structures, decorative elements, green spaces, etc. located on the territory of the Embankment with care, to observe cleanliness, public order and the requirements of these Rules.
1.2. The security service of the shopping mall is responsible for protecting the territory of the Embankment and ensuring control over public order.
1.3. The owners are responsible for the safety of personal belongings on the territory of the Embankment.
1.4. Visitors are required to comply with the rules of silence in public places and sanitary standards of permissible noise levels.
1.5. Walking pets is allowed only if the Rules for Keeping Pets in Kyiv (hereinafter referred to as the Rules for Keeping Pets) are observed, approved by the decision of the Kyiv City Council dated 25.10.2007 No. 1079/3912, namely:
1.5.1. The person accompanying the animal is obliged to ensure the safety of the accompanied animal, surrounding people and animals, as well as property from causing harm to the accompanied animal.
1.5.2. The person accompanying the animal is obliged to clean up the excrement after their animals.
1.5.3. Walking of potentially dangerous dog breeds, the list of which is established by the appendix to the Rules for Keeping Pets, is carried out necessarily on a short leash (no more than 1.2 m.) and in a muzzle.
1.9. Violation of the requirements of environmental legislation on the
territory of the Embankment and the adjacent water area entails disciplinary, administrative, civil and/or criminal liability.
1.10. Periodically, the SEC Administration holds mass events to popularize the SEC with photo and video recording of such events. By staying on the Embankment, the Person gives his consent to photographing and video recording both him personally and minor/young members of his family, as well as his animals, within the framework of such events. By staying on the embankment, the Person also gives his/her unconditional consent to the free use of photo and video materials taken on the embankment, which contain his/her image and/or images of minor/young members of his/her family, when creating advertising, information messages about the activities of the shopping center and for other purposes related to the activities of the shopping center, and also gives his/her consent to the storage, reproduction, distribution and processing of the specified photo and video materials.
2. RULES
USING THE WATER AREA ADJACENT TO THE EMBANKMENT
2.1. Catching fish from the water area adjacent to the Embankment is permitted for personal consumption, if it is carried out in accordance with the norms of the current legislation of Ukraine, in particular: during the permitted period, with non-prohibited fishing gear, etc., with mandatory compliance with the Rules established for amateur and sport fishing.
2.2. Until the Embankment is fully operational, the mooring of any river transport, as well as other water transport, including catamarans, jet skis, etc., is temporarily not possible.
2.3. Swimming in the water area adjacent to the Embankment is prohibited, since the water area has not been designated by local executive authorities as a place for swimming and is not equipped for swimming by people.
3. ON THE TERRITORY OF NABEREZHNAYA, IT IS PROHIBITED:
3.1. Drinking and consuming alcoholic beverages and/or narcotic substances and being intoxicated or under the influence of narcotic substances;
3.2. Using pyrotechnics, fireworks, etc.;
3.3. Smoking in places not designated for this purpose;
3.4. Carrying flammable, explosive, poisonous, flammable and radioactive substances, firearms and cold weapons, gas weapons and ammunition, electroshock devices, mechanical or automatic aerosol sprayers of all types;
3.5. Trading in souvenirs or any other products, carrying out other commercial activities (including, but not limited to, the sale and distribution of advertising brochures, flyers, organizing gatherings and performances by artists, holding concerts and flash mobs) without the appropriate permit;
3.6. Photo and video shooting for commercial purposes, without appropriate permission, with the exception of “Selfies” and photos for personal purposes, which are taken using mobile phones and/or amateur cameras or video cameras, if the person taking the photo and video does not create inconvenience to other visitors or violate public order by his/her actions;
3.7. Posting announcements, announcements, advertising posters;
3.8. Lighting a fire or installing barbecues;
3.9. Damage, destruction, digging up green spaces;
3.10. Installation of light folding furniture;
3.11. Litter of the Embankment and the adjacent water area with household and other waste, throwing garbage outside specially designated places;
3.12. Destruction and damage of elements, objects of improvement, small architectural forms and other structures;
3.13. Touching, moving inventory, decorations, Christmas tree decorations, decorative elements, any electrical equipment that is not intended for games and entertainment;
3.14. Riding bicycles, skateboards, scooters, electric scooters, roller skates, gyro scooters, mopeds, motorcycles, etc. (except for children under 7 years old on children’s bicycles, scooters, skateboards under adult supervision), descending the slope on sleds, snowmobiles, skis, boards and other similar means;
3.15. Presence of persons who violate public order, engage in begging;
3.16. Check-in, parking and washing of vehicles, including electric scooters;
3.17. Pitching tents;
3.18. Hang hammocks;
3.19. Jump, dive from bridges, piers;
3.20. Enter the territory of unfinished objects or places that are fenced off with prohibitory signs.
3.21. Use of obscene language, speaking in raised tones, committing actions that offend the honor and dignity of other persons;
3.22. Leave bags, belongings and other objects unattended. If forgotten, ownerless items are discovered, the visitor is obliged to immediately inform the Administration of the Shopping Center or the Security Service of the Shopping Center. Before the arrival of the Shopping Center employees, it is forbidden to independently carry out any actions with the discovered object.
3.23. Stay of children under 12 years of age without adult supervision;
3.24. Leave children without adult supervision;
3.25. Without the consent of the Administration, play musical instruments, use sound and video playback devices (except personal ones);
3.26. Turn on and listen to loud music;
3.27. Organize and conduct gambling on the territory of Naberezhnaya and participate in them.

Official rules for participation in the promotion of the RIVER MALL shopping center
under the conditional name “Birthday of the shopping center”
1. Organizer of the Promotion
· The Customer of the Promotion is LLC “Information Agency “Free Ukraine” (hereinafter referred to as the “Customer”).
· The Organizer and Executor of the Promotion is LLC “COMMAND PLUS AR” (hereinafter referred to as the “Organizer or Executor”)
The purpose of the Promotion is to promote the River Mall shopping center to increase the number of buyers and stimulate sales at retail outlets, as well as increase the audience in social networks.
Definition of terms:
• Participant of the Promotion – a person who meets clauses 5.1. and 5.2. and has fulfilled all the points of Section 5.
• Promotion Gifts – gifts listed in Section 2.
• Registration Form – a registration form filled out by the Participant of the Promotion in the River Mall shopping center mobile application.
• Check registration period: from 10:00 on September 6, 2025 to 17:00 on September 20, 2025.
• Promotion period: from 10:00 on September 6, 2025 to 21:00 on September 20, 2025.
Determination of Gift Recipients – the procedure for determining Gift Recipients, which will be announced by the Promotion Organizer by holding a draw on the stage, which will be located on the embankment of the River Mall shopping mall, at 20:00 on September 20, 2025. The Organizer reserves the right to change the time and date of the draw.
2. Promotion Gifts
2.1. The Main Promotion Gift is: a Volkswagen Passat car in the Business 1.5eTSI configuration
2.2. From the moment of receiving the Promotion Gifts, namely from the moment of signing the Gift acceptance and transfer act, the Promotion Organizer is not responsible for cases of loss of the ability to use the Gift by the Gift Recipient due to circumstances beyond the Organizer’s control.
3. Duration and territory (place) of the Promotion
3.1. The Promotion is held at the River Mall shopping mall at the address: Kyiv, Dniprovska naberezhna, 12 (hereinafter referred to as the “Promotion Place”).
3.2. The Promotion begins at 10:00 on September 6, 2025 and ends at 21:00 on September 20, 2025 after the procedure for determining the Recipient of the Main Gift (hereinafter referred to as the “Promotion Period”).
3.3. The promotion consists of the following stages:
Stage 1 – visitors to the River Mall shopping center make a purchase for the amount of UAH 1,500 or more with one check during the Promotion Period in all stores of the shopping center (except the Silpo store).
Stage 2 – from 10:00 on September 6, 2025 to 17:00 on September 20, 2025, visitors:
– register the Check and fill out the Registration Form in the River Mall shopping center mobile application and scan/attach the Check,
– send the Participant Questionnaire and Check
– become participants in the Promotion.
Stage 3 – determination of Gift Recipients, which will take place at 20:00 on September 20, 2025 by means of a draw on the stage, which will be located on the embankment of the shopping center. The organizer reserves the right to change the time and date of the draw.

4. Products participating in the Promotion
4.1. The Promotion includes products from all tenants of the River Mall shopping mall, except for the Silpo store (hereinafter referred to as Promotional Products)
5. Participants of the Promotion and requirements for the Participant of the Promotion
5.1. The Promotion is open to legally capable citizens of Ukraine who are 18 years old at the time of the start of the Promotion. Participants who are 14 years old but under 18 years old (incompetent persons) and persons with limited legal capacity are entitled to participate in the Promotion only with the permission of their parents or legal guardians.
5.2. Owners and employees of the Organizer and the Customer or representatives of tenants (including, but not limited to: brand owners and service personnel of the shopping center stores), owners and employees of advertising agencies, cleaning, security and other organizations involved in the Promotion and servicing the shopping center, as well as immediate members of their families, are not recognized as Participants in the Promotion and cannot participate in it. Immediate family members include spouse, children, parents, siblings, grandparents, grandchildren, other dependents or guardians, and persons directly related to the owners and employees of the Promotion Organizer, Promotion Supplier, Promotion Executor, and tenants of the shopping center.
6. Procedure for participation in the promotion
6.1. In order to become a Participant of the Promotion, it is necessary to perform the following actions:
1) Come to the River Mall shopping mall during the Promotion Period, purchase a product/service for an amount of UAH 1,500 or more (Mandatory purchase), receive an appropriate fiscal, cash or merchandise, properly executed check for the amount of UAH 1,500 (hereinafter referred to as the “Check”), which must clearly indicate the place (address) of purchase, date and amount of purchase.
2) Register the Check by filling out the Registration Form in the River Mall mobile application (hereinafter referred to as the Registration Form) and adding a photo/scan of the Check, which must be duly checked by a representative of the Organizer for compliance with the Promotion Terms and Conditions. Only after verification will the Participant of the Promotion receive the right to participate in the Promotion Gifts draw.
3) To receive a unique number of the Participant of the Promotion (unique number of the Registration Form), the buyer must register the Check by filling out the Registration Form containing the personal information of the Participant of the Promotion and detailed information about the purchase.
6.2. 1 (one) Check for the purchase of a Promotional Product for the amount of 1500 UAH. gives the right to fill out 1 (one) Participant Registration Form and receive 1 (one) unique Participant number of the promotion. If the amount in the Check is more than 1500 UAH. The Participant of the Promotion receives such a number of registrations – unique numbers, which is a multiple of 1500 UAH. (For example, a Check for the amount of 30,000 UAH / 1500 UAH = 20 Registration Forms = 20 unique numbers. In this case, the participant does not need to register his Check 20 times – the required number of Registration Forms and unique numbers will be generated automatically).
6.3. ATTENTION! On the day of the draw, registration is closed at 17:00.
6.4. Only fiscal checks of the Participant of the Promotion with the date and time corresponding to the Period of the Promotion and filled in in accordance with clauses 6.1 and 6.2 are allowed to participate in the Promotion.
6.5. One Check can be registered only for one Participant of the Promotion. In case of detection of registration of a Check for two or more Participants of the Promotion, the Organizer does not allow all persons to participate in the Promotion.
6.6. All fiscal checks entered in the register participate in the draw of the Main Gift, provided that the Participants of the Promotion comply with the current Official Terms and Conditions.
6.7. Participants of the Promotion must keep the originals of the settlement documents (fiscal checks) for the purchased products to confirm the purchase.
6.8. Only an individual who is registered as a Participant of the Promotion in accordance with the terms and conditions of the Promotion has the right to participate in the Promotion. Confirmation of the registration of an individual as a Participant of the Promotion is a special, duly completed Registration Form of the Participant of the Promotion, which is available in electronic form with the Organizer.
6.9. By participating in the Promotion, the Participant of the Promotion does not pay any fees related to participation in the Promotion. The Promotion Incentive Fund and the Main Gift are not formed from the contributions of the Participants of the Promotion. The Customer/Organizer of the Promotion does not receive remuneration from the Participants of the Promotion for their participation in the Promotion. The Promotion is not a game of chance, lottery, service in the field of gambling business or a competition, and these Rules are not a public promise of remuneration or conditions of the competition.
6.10. Transfer of the rights of the Participant of the Promotion to other persons is not allowed. Any violation by the Participant of these Rules and Conditions of the Promotion is grounds for deprivation of his right to participate in the Promotion.
6.11. The Organizer of the Promotion reserves the exclusive right to refuse registration as a Participant of the Promotion to any person whose Check raises doubts about its authenticity or the purchase made in the stores of the Shopping Center, as well as if the Organizer’s representative has sufficient grounds to believe that the individual cannot participate in the Promotion (does not meet the conditions stipulated in these Rules and Conditions of the Promotion).
6.12. The fiscal check must be kept throughout the entire period of the promotion. The check cannot be transferred to another person.
6.13. Confirmation of participation in the Promotion is the registered Registration Forms in the River Mall mobile application, receipt of a unique number of the Participant of the Promotion and the Purchase Check. The check must be kept until the end of the draw and the announcement of the winners or receipt of the Gift.
6.14. When participating in the Promotion, the Participants of the Promotion undertake to:
1) comply with the requirements of these Rules and Conditions of the Promotion and the norms of the current legislation of Ukraine;
2) provide complete, correct and reliable information specified in these Rules and Conditions of the Promotion;
3) not knowingly cause inconvenience or hinder other Participants of the Promotion;
4) not take actions that call into question the legality of the Participant’s participation in the Promotion.
6.13. From the moment of acceptance of the terms of these Rules and Conditions of the Promotion, by filling out and signing the Participant’s Questionnaire, consent to the terms of these Rules and Conditions of the Promotion and consent to the processing of personal data is considered to be provided by the relevant Participant of the Promotion in accordance with the requirements of the legislation of Ukraine.
6.14. A Participant of the Promotion who does not agree with the terms of these Rules and Conditions of the Promotion and/or refuses to provide consent to the processing of his/her personal data loses the right to further participate in the Promotion.
6.15. Providing by a Participant of inaccurate/incorrect data provided for participation in the Promotion, including regarding the means of communication with such a Participant of the Promotion, is a violation of the Rules and Conditions of the Promotion and deprives such a Participant of the right to further participate in the Promotion and releases the Customer/Organizer of the Promotion from any obligations to such a Participant of the Promotion.
6.16. In the event of a violation by a Participant of the obligations specified in these Rules and Conditions of the Promotion, which caused the Organizer and/or the Customer of the Promotion to incur losses, the Participant of the Promotion is obliged to compensate for such losses in full.
6.17. Participants of the Promotion act personally, on their own behalf, voluntarily and independently. Participants of the Promotion assume all risks of liability and consequences associated with possible participation in the Promotion and receipt of the Main Gift.
7. Procedure for determining the Recipient of the Main Prize
7.1. The Final of the Promotion will be held on September 20, 2025 at 8:00 PM (in the absence of air raids and other reasons beyond the control of the Organizer of the Promotion) on the stage located on the embankment of the River Mall shopping mall. The personal presence of the Participant of the Promotion at the place of the Final of the Promotion is mandatory.
7.2. The Participant of the Promotion, who will be determined as having won the Main Prize, presents: 1) the original of the relevant payment document (fiscal check)
2) confirmation of the unique number of the Participant of the Promotion in the River Mall mobile application
3) the original of the passport and TIN.
7.3. Refusal to provide the above documents, their provision later than the specified deadline, provision of documents that have signs of falsification, provision of incomplete / illegible documents, refusal to present the original passport of a citizen of Ukraine / certificate of assignment of an individual tax number (registration number of the account card of an individual – taxpayer) / original check confirming the purchase in accordance with these Rules when signing the Act of Acceptance and Transfer / refusal to sign the Act of Acceptance and Transfer of the Gift deprives such a Participant of the Promotion of the right to receive the Main Gift of the Promotion and it is considered that such a Participant of the Promotion voluntarily refused to receive the Main Gift.
7.4. At 20:00 on September 20, 2025, the procedure for determining the Recipient of the Main Gift will begin, as announced by the Host of the Promotion Final.
7.5. The procedure for determining the Recipient of the Main Promotion Gift will be as follows:
· By random selection, the Host of the Promotion Finale takes turns pulling out the printed unique numbers of the Promotion Participants from the drum, announces it from the stage and compares this unique number of the Promotion Participant with the database in the form of a spreadsheet, where all the data of all registered Promotion Participants is collected. The Host announces the last name, first name and patronymic of the Promotion Participant whose unique number indicated in the database coincides with the printed unique number that was pulled out from the lottery machine.
· If the Promotion Participant, whose unique number was announced by the Host, is present at the venue of the Promotion Finale, he goes on stage and becomes a Candidate for receiving the Main Promotion Gift.
· For additional verification of the personal presence of the Participant of the Promotion, whose unique number was announced, at the venue of the Promotion Final, the Host has the right to call three times the relevant phone number that was specified in the Participant Registration Form of the Promotion;
· Participants of the Promotion must answer the call at the number specified in the Registration Form, reach the stage and present to the Organizer’s representatives the documents specified in clause 6.2 of these Rules and Conditions of the Promotion. If they are available, such Participant of the Promotion becomes a Candidate for receiving the Main Prize of the Promotion.
· If the Participant of the Promotion, whose unique number was drawn from the drum during the Promotion Final, is personally absent from the venue of the Promotion Final, then such Participant is deprived of the right to participate in the Promotion Final.
· In total, 5 (five) Applicants for the Main Prize of the Promotion will be selected in this way, who will participate in the final stage of the Main Prize draw.
· In the final stage of the draw, the five applicants for the Main Prize of the Promotion must randomly choose one of the five keys to the Main Prize of the Promotion. 4 keys are fake and only 1 is real, the one that will activate/open the Main Prize of the Promotion. The winner of the Promotion and the Recipient of the Main Prize will be considered the one who randomly chooses the real key and opens/activates the Main Prize.
· The Recipient of the Main Prize will be entered into the protocol drawn up by the Organizer and the Executor of the Promotion and certified by a notary.
7.6. The results of the draw will be published on the website and official pages of the shopping center on social networks Facebook or Instagram.
7.7. From the moment of receiving the Main Gift, namely from the moment of signing the act of acceptance and transfer of the Main Gift, the Organizer of the Promotion is not responsible for cases of loss of the opportunity to use the Main Gift by the Winner of the Promotion due to circumstances beyond the control of the Organizer.
7.8. Taxation of the Gift is carried out in accordance with the current legislation of Ukraine. The Organizer is the tax agent.
7.9. The Winner of the Promotion accepts the official terms of the Promotion and is familiar with the fact that all taxes, payments and fees that arise when registering the possibility of realizing the Main Gift in accordance with current legislation are paid by the tax agent.
7.10. The Participant who became the Winner of the Promotion cannot cede such right to third parties.
8. Disclaimer
8.1. Only those Registration Forms approved by the Organizer for participation in the Promotion are entitled to participate in the Promotion. Checks or Registration Forms containing inaccurate data, filled out illegibly, or having other defects do not give the right to participate in the Promotion and are not allowed by the Organizer to participate in the Procedure for determining the Recipient of the Main Gift of the Promotion. Responsibility for the consequences of such violations of the Rules and Conditions of the Promotion lies with the persons who committed them.
8.2. The Organizer bears no responsibility for the accuracy of the information provided by the Participant of the Promotion and reserves the exclusive right to refuse any person who has provided inaccurate information about themselves to participate in the Finale of the Promotion.
8.3. By participating in the Promotion, its Participants agree that in the event of their being declared Winners, entitled to receive Promotion Incentives and/or receiving the Main Gift, their names and photographs may be announced and used by the Organizer in printed, audio and video materials, including for the purpose of advertising and profit-making, and such use is free of charge and not subject to compensation in any form.
8.4. By filling out the Participant Form, individuals agree that the information received by the Organizer from the Participants of the Promotion who filled out the Participant Form is not considered confidential and may be used by the Organizer at its sole discretion, taking into account the provisions of the current legislation of Ukraine regarding the circulation of such information.
8.5. Cash and/or any other compensation for the Main Gift is not issued. Replacement of the Main Gift with any other good is not allowed. The Main Gift is not exchangeable and cannot be returned.
9. Rights and obligations of the Organizer
9.1. The Organizer reserves the right to change the date of the draw and the determination of the Main Gift Recipient. Information about the change in the date of determination of the Gift Recipients will be available on the Customer’s social pages.
9.2. The Organizer does not notify the Recipient of the Main Gift of the Promotion again about his victory.
9.3. The Organizer of the Promotion is not responsible for the inability of the Participant to receive the Promotion for any reasons that do not depend on the Organizer, including due to the Participant of the Promotion providing incorrect/or incomplete data, etc., which are necessary for participation in the Promotion. In this case, such a participant of the Promotion is deprived of the right to receive any compensation from the Organizer of the Promotion.
9.4. The Organizer of the Promotion is not responsible for the future use of the Main Gift and for the inability to use it for any reasons.
10. Final Provisions
10.1. In the event of any disputes regarding the interpretation of the terms of the Promotion, the interpretation of the Promotion Organizer shall be recognized as official, which shall be final and binding for all persons/Participants of the Promotion and shall not be subject to appeal. The Organizer’s decisions on all issues related to the Promotion shall be considered final, non-appealable and applicable to all Participants of the Promotion.
10.2. The Organizer of the Promotion may invalidate any registration and prohibit further participation in this Promotion to any person who tampers with or benefits from tampering with the registration process or other stages of the Promotion, or acts in violation of these Rules and Conditions of the Promotion, acts in a destructive manner or takes actions with the intention of harassing, insulting, threatening or causing harm to any other person who may be associated with this Promotion.
10.3. The Customer/Organizer is not liable in the event of force majeure circumstances, such as natural disasters, fire, flood, military actions of any nature, blockades, significant changes in the legislation in force in the territory of the Promotion, other circumstances beyond the control of the Customer/Organizer.
10.4. The Customer/Organizer is not responsible for the inability of the Participant of the Promotion to receive the Main Gift for any reasons beyond the control of the Organizer. In this case, such Participant is not entitled to receive any compensation from the Organizer.
10.5. The Customer/Organizer is not responsible for: the further use of the Main Gift by the Participants of the Promotion after their receipt, any warranty obligations regarding the quality of goods/services provided by third parties, as well as for the possible consequences of their use.
10.6. The Customer does not enter into any disputes regarding the recognition of any persons as Participants of the Promotion and the rights to receive the Main Gift. The Customer does not assume responsibility for determining the rights of the parties in any disputes regarding the conduct of this Promotion.
10.7. Receiving the Main Gift is provided only by the Participants of the Promotion and cannot be considered as a monetary obligation.
10.8. The Organizer uses the Main Gift, which the Participants of the Promotion refused to receive, at its own discretion, taking into account the provisions of the agreement between the Customer and the Organizer.
10.9. The Customer of the Promotion is responsible for calculating and paying taxes in connection with the delivery of the relevant Promotion Incentives and the Main Gift, as well as for failure to fulfill this obligation.
10.10. In accordance with the requirements of Article 634 of the Civil Code of Ukraine on accession agreements, namely, regarding the possibility of concluding such an agreement by joining one party to the proposed agreement, by participating in the Promotion, all Participants agree to these Rules and Conditions of the Promotion and undertake to comply with them.
10.11. These Rules are a preliminary agreement, and in case of refusal to comply with these Rules and Conditions of the Promotion, the Winners lose the right to receive the Main Gift.
10.12. All results of the Promotion are final and cannot be appealed.
10.13. The Organizer’s decisions on all issues related to the Promotion are considered final and apply to all its participants. The Organizer reserves the right to change the terms, terms of the Promotion, the procedure for issuing prizes, suspend or cancel the Promotion. The Organizer is not responsible for violations of the rights of third parties by the Participants of the Promotion. The Organizer is not responsible for changing the Terms of the Promotion in the event of force majeure circumstances that do not depend on the will of the Organizer, but affect the course of the Promotion. Participation in the Promotion means agreement with all its terms.
10.14. These rules may be changed/amended by the Organizer throughout the Promotion Period, while information about changes and additions will be provided by posting on the SEC website or in its social networks. Such changes and additions shall enter into force upon publication, unless otherwise provided by the changes/additions to the current Official Terms.
10.15. By participating in the Promotion, each Participant hereby confirms that he/she has read these Terms and Conditions of the Promotion and his/her full and unconditional agreement with them. Violation by the Participant of these Terms and Conditions or the Participant’s refusal to properly fulfill these Terms and Conditions shall be deemed to be the Participant’s refusal to participate in the Promotion and receive the winnings, and such person shall not be entitled to receive any compensation from the Organizer and/or other persons.
11. Other Terms.
11.1. By participating in the Promotion, the Participant/Winner of the Promotion/Recipient of the main Gift, in particular, confirm their agreement with the following:
Each Participant of the Promotion hereby gives their consent to the processing and free use of personal data provided by the Participant of the Promotion, namely: name, surname, patronymic, telephone number, e-mail address, as well as other data provided by the Participant of the Promotion to participate in the Promotion (hereinafter referred to as “Personal Data”) (Processing of personal data on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, as well as data relating to health or sexual life – IS NOT PERFORMED) by the Organizer of the Promotion, for marketing and/or any other purpose by methods that do not violate the current legislation of Ukraine (including by transfer to third parties), in particular, to the free use of his name, surname, or other information about him for advertising/marketing purposes, including, but not limited to, sending information, messages (including advertising if the appropriate boxes of the Participant’s Questionnaire are checked), without any restrictions on the territory, time and method of use, and such use will not be compensated in any way by the Organizer of the Promotion and/or any third party. The provision of such consent is considered within the meaning of Articles 296, 307, 308 of the Civil Code of Ukraine and the Law of Ukraine “On the Protection of Personal Data”
The Organizer of the Promotion, in accordance with the procedure specified by the Law of Ukraine “On the Protection of Personal Data”, has the right to process and use personal data (passport data, identification code, etc.) of the Participants/Winners of the Promotion in any way not prohibited by the current legislation of Ukraine, including, but not limited to, for the purpose of fulfilling the requirements of the legislation of Ukraine regarding advertising, taxes, and in the field of accounting.
11.2. Each Participant of the Promotion agrees that the Personal Data provided by him/her is used by the Organizer of the Promotion solely for the purpose of conducting the Promotion.
By participating in the Promotion, each Participant of the Promotion confirms that from the moment of the beginning of his/her participation in the Promotion, he/she has been duly informed about the purpose of collecting his/her Personal Data, and has been familiarized with the rights provided for in Article 8 of the Law of Ukraine “On Personal Data Protection”.
The processing of personal data may be carried out by the Organizer of the Promotion independently or may be transferred to other operators on the basis of an agreement with the condition of maintaining confidentiality.
The Organizer of the Promotion does not bear any responsibility for the protection of personal data posted by the Participant from unlawful or accidental access to them, destruction, distortion, blocking, copying, distribution of personal data, as well as other unlawful actions. Just as the Organizer of the Promotion does not bear any responsibility for violation of the rights of third parties as a result of the actions of the Participant of the Promotion in posting such personal data.

On August 23 and 24, at the Ethnofestival in River Mall, the creative workshop “YAR” will hold pottery workshops.
Participants will be able to get acquainted with traditional Ukrainian crafts and create their own clay vases on a potter’s wheel. Children from 4 years old can participate in the workshop.
